These terms and conditions apply to every offer made by RemBel B.V. ("Emergency Bag", "we", "us") and to every agreement formed between Emergency Bag and you as a customer ("you").
Article 1. Definitions
- Emergency Bag: RemBel B.V., based in Zwijndrecht, the Netherlands, registered with the Dutch Chamber of Commerce (KVK) under number 98209205, VAT number NL868400051B01.
- Customer: the individual or legal entity entering into an agreement with Emergency Bag.
- Agreement: the agreement between Emergency Bag and the customer regarding the purchase of products via the webshop.
- Cooling-off period: the period during which the customer can exercise their right of withdrawal.
Article 2. Applicability
- These terms apply to every offer made by Emergency Bag and to every distance agreement between Emergency Bag and the customer.
- The text of these terms is made available to the customer before the agreement is concluded.
Article 3. The offer
- All offers on the website are without obligation. Emergency Bag reserves the right to change or amend the offer.
- Obvious mistakes or errors in the offer (such as clear pricing errors) do not bind Emergency Bag.
- Every offer contains sufficient information for the customer to clearly understand the rights and obligations attached to accepting it.
Article 4. The agreement
- The agreement is formed at the moment the customer accepts the offer and meets the associated conditions.
- Emergency Bag confirms the order by email as soon as possible.
Article 5. Right of withdrawal (cooling-off period)
- When purchasing products, the customer has the right to cancel the agreement without giving a reason within a period of 30 days, starting the day after receipt of the product. This is a longer period than the statutory minimum cooling-off period of 14 days; this 30-day period applies in total and is not in addition to the statutory period.
- During this period, the customer must handle the product and its packaging with care. The product may only be unpacked or used to the extent necessary to assess its nature and characteristics.
- To exercise the right of withdrawal, the customer must notify Emergency Bag within the cooling-off period via info@emergencybag.nl or the withdrawal form on the website.
- The customer returns the product within 14 days of notification, with all accessories supplied and in its original condition, where reasonably possible.
- The cost of returning the product is borne by the customer, unless stated otherwise.
- Emergency Bag refunds the full purchase amount (including standard shipping costs) within 14 days of receiving the return notification, provided the product has been received back or proof of shipment has been provided.
Article 6. Prices
- All prices are in euros and include VAT, unless stated otherwise.
- Any shipping costs are shown separately before completing the order.
- Emergency Bag reserves the right to change prices; orders already placed are not affected retroactively.
Article 7. Payment
- Payment is made via the payment methods offered on the website (including iDEAL/Wero, credit card).
- Payment is made when the order is placed, unless otherwise agreed.
Article 8. Delivery and performance
- Emergency Bag aims to ship orders as quickly as possible — see the "Shipping & Returns" page for current delivery times.
- If delivery is delayed, or if an order cannot be fulfilled in full or in part, the customer is notified as soon as possible.
Article 9. Conformity and product-level warranty
- Emergency Bag guarantees that products meet the agreement and the specifications listed on the product page.
- Any manufacturing defects will be repaired, resolved, or the product replaced free of charge, in consultation with the customer.
Article 10. Liability
- Emergency Bag provides an emergency bag as an aid to self-sufficiency during the first 72 hours of an emergency. Emergency Bag cannot guarantee that using the products will be sufficient in every conceivable situation, and accepts no liability for damage or injury resulting from the use (or non-use) of the products, except in cases of intent or gross negligence.
- The customer remains responsible for periodically checking the expiry dates of consumable items included in the bag.
Article 11. Complaints procedure
- Complaints about the performance of the agreement must be submitted to Emergency Bag fully and clearly described within a reasonable time, via info@emergencybag.nl.
- Emergency Bag responds to submitted complaints within 14 days.
Article 12. Governing law and disputes
- Dutch law exclusively applies to agreements between Emergency Bag and the customer.
- Disputes will be resolved through mutual consultation where possible. If that fails, the competent court in Rotterdam (which has jurisdiction over Zwijndrecht) has jurisdiction, unless mandatory consumer law provides otherwise.
